Justin Timberlake is being sued over his song "Damn Girl".
The singer and his collaborator Will.I.Am are accused of stealing the track off the former boybander's 2006 solo record "FutureSex/LoveSounds" from the late disco artist Perry Kibble's tune called "A New Day Is Here at Last".
Kibble's sister Janis McQuinton filed a copyright infringement lawsuit in U.S. District Court on Wednesday, February 17 through Music publisher PK Music Performance, Inc., according to Billboard.
After Kibble died in 1999, the rights to his music transferred to McQuinton who found out in August 2015 that the hook, rhythm, harmony and melody from Timberlake's song were very similar to those of her brother's.
"Specifically, a substantial part of the drum, conga drum, organ, bass guitar, electric guitar, and saxophone parts in 'Damn Girl', were all copied from 'A New Day Is Here at Last'," Steven M. Lester of La Reddola, Lester & Associates LLP wrote in the suit.
"A New Day Is Here at Last" was written by Kibble in 1969 and was recorded by J.C. Davis.
McQuinton is seeking damages and an injunction to stop Timberlake, Will.I.Am, Sony Music Entertainment as well as several other music publishers and distributors listed as defendants from reproducing, distributing and publicly performing "Damn Girl".
